Panic is driving policy

April 9, 2020

The actions, orders and mandates of our Local, State and Federal governments are the result of panic. Rather than approach this alleged disaster in a calm and thoughtful manner, our governments have chosen a Disaster Emergency Proclamation and used this to violate our laws.

Consider one of the violations of our basic Constitutional laws committed by our governments. The law is stated in the United States Constitution, 14th Amendment. This law establishes and guarantees all people due process of law and equal protection of the laws. And the Alaska Constitution, Article 1, Section 1; “...all persons are equal and entitled to equal rights, opportunities and equal protection under the law...”

How did the government violate these basic laws? Upon reading the State of Alaska COVID-19 Health Mandate, FAQs sheet of Health Mandate 011, I found this question asked on page 3: “What about persons experiencing homelessness?”to which the state replied: “This population is exempt …” How can part of our population be exempt from a Disaster Emergency Proclamation declared by our Governor as law?

In Haines, I have spoken to several people that have been informed by our local government that they must stay at home. I have not been told to stay at home. Is this equal protection?

I ask that our government not pass legislation based on panic and fear.
